The single most important question in an Indian termination matter is whether you are a workman under Section 2(s) of the Industrial Disputes Act, 1947. The answer changes your rights substantially.

If you are a workman

The Industrial Disputes Act protects employees doing manual, skilled, technical, operational or clerical work, broadly speaking, and excludes those in mainly managerial or supervisory roles above a wage threshold. For a workman with the required length of continuous service, retrenchment must comply with Section 25F: written notice of one month or pay in lieu, plus retrenchment compensation of fifteen days' average pay for every completed year of continuous service. Continuous service is defined generously, and 240 days of work in a year generally counts as a year.

A termination that skips these requirements is bad in law, and the remedies can include reinstatement or compensation through the industrial dispute machinery.

If you are not a workman

Managers and senior employees are governed mainly by their contract and the applicable state Shops and Establishments Act, which typically prescribes minimum notice after a qualifying period of service. Your claims are for contractual notice or pay in lieu, earned dues, and anything your contract or policy promises, such as severance or variable pay that has accrued.

In every case

Termination must not be a disguise for something worse. A termination framed as simple but actually founded on misconduct allegations, or one that targets an employee for a protected complaint, raises separate issues. And regardless of category, earned salary, leave encashment under policy, and gratuity where the Payment of Gratuity Act, 1972 applies, remain payable.

Keep everything in writing: the termination letter, the contract, payslips and the F&F computation. The strength of a termination claim is usually decided by the paper.
